The Civil Guard is investigating a group instant messaging hate crimes against the Forces Security (23/09/2016)

Some of the messages in the group, with about 200 participants and created with the aim of alerting the location of police checkpoints, contained serious insults against agents of the Guardia Civil and Local Police

Operation 'RESPECT' is the third action for hate crimes that the Meritorious done in the Murcia region so far this year

The Civil Guard in the region of Murcia has developed in Aguilas operation 'RESPECT', aimed at identifying members of a group of mobile phone messages they used this channel, among others, to pour serious insults and slander against police Civil guard and local police.

The group was created to alert police of the location of controls.

So far, the operation has resulted in three people arrested and 19 more under investigation as alleged perpetrators of crimes committed during the exercise of fundamental rights and public freedoms guaranteed by the Constitution (hate crime) 1 and crime of serious injuries.

The investigation last July began when the Civil Guard, in collaboration with the local police Eagles, detected the existence of a group of mobile messaging, with about 200 participants, created with the intention of alerting the different points police control established in the municipality and in which the allegedly serious insults against agents were also published.

The first investigations allowed to determine that although the authors of the messages, a priori, not incurred in any criminal offense, whether there was a clear hazard to public safety, to make known instantly the location of police devices.

The Civil Guard recalls that these controls are aimed, among others, to prevent the commission of serious crimes, as well as the anticipation of any activity related to the terrorist threat, one of the priorities, as in the rest of Europe, the Security forces of Spain.

Inquiries have continued to discover that some of the messages also were used to discredit and insult the agents of the Civil Guard and local police, using nicknames to identify personally any of them and even to wish his death.

The Civil Guard has found that the activity of any of the users and especially administrators group, promotes and encourages hatred against a person belonging to a labor collective group, in this case the Civil Guard and the local police.

Operation 'RESPECT' has resulted, so far, with the arrest of three people and another 19 under investigation as alleged perpetrators of crimes committed during the exercise of fundamental rights and public freedoms guaranteed by the crime Constitution of hate and serious injuries.

The operation is still open to determine the extent of involvement of other members of the group in the crimes under investigation.

Those arrested and the proceedings initiated have been made available to the Magistrate's Court in Lorca (Murcia).

Third performance of the Meritorious against hate crimes in Murcia

This operation is the third that develops in the region of Murcia framed in Instruction 16/2014 of the Ministry of State Security, for which the "Action Protocol for the Security Forces for approving Crimes hatred and behaviors that violate legal regulations on Discrimination ".

Last May, in the framework of the operation 'KABERNAL', aimed at clarifying the serious aggression committed against two young men in the village of Murcia Cabezo de Torres, the Civil Guard dismantled a criminal group linked to radical ideologies, with the arrest six persons as alleged perpetrators of crimes committed during the exercise of fundamental rights and public freedoms guaranteed by the Constitution (hate crime) and injuries.

In the records kept in the homes of two of the detainees, the Civil Guard seized several weapons and numerous related anti movements extreme right and neo-Nazi effects.

In March, as part of the operation 'ROD', aimed at clarifying the brutal aggression committed against a young, minor, in the town of Santiago de la Ribera San Javier, the Civil Guard arrested a person allegedly linked radical ideologies of the extreme left, on suspicion of crimes committed during the exercise of fundamental rights and public freedoms guaranteed by the Constitution (hate crime) 1 and injury.

1 SECTION XXI

Crimes against the Constitution

CHAPTER IV

Of the offenses relating to the exercise of fundamental rights and public freedoms.

SECTION 1. Of the offenses committed during the exercise of fundamental rights and freedoms guaranteed by the Constitution public

Article 510.

1. shall be punished with imprisonment of one to four years and a fine of six to twelve months:

a) Those who publicly encourage, promote or incite directly or indirectly to hatred, hostility, discrimination or violence against a group, part of it or against a particular person because of their membership in that, for reasons of racism, anti-Semitism or other concerning ideology, religion or beliefs, family situation, membership of members of an ethnic group, race or nation, national origin, gender, sexual orientation or gender identity, gender, illness or disability.

b) Those who produce, develop, possess in order to distribute, provide third parties access, distribute, disseminate or sell written or any other kind of material or media whose content shall be able to encourage, promote, or incite directly or indirectly hatred, hostility, discrimination or violence against a group, a part thereof, or against a person because of their membership in one, racist, anti-Semitic or other related to ideology, religion or belief reasons, family situation, membership of the members of an ethnic group, race or nation, national origin, gender, sexual orientation or gender identity, gender, illness or disability.

c) publicly deny, trivialize or extol seriously the crimes of genocide, crimes against humanity or against persons and property protected in the event of armed conflict, or

extol their authors, when they had committed against a group or a part thereof, or against a particular person because of their membership of the same, racist, anti-Semitic or other related to ideology, religion or belief reasons, family situation or membership of members of an ethnic group, race or nation, national origin, gender, sexual orientation or gender identity, gender, illness or disability, when in this way promote or encourage a climate of violence, hostility, hatred or discrimination against them.

2. shall be punished with imprisonment of six months to two years and a fine of six to twelve months:

a) Those who infringe the dignity of people through actions involving humiliation, contempt or discredit any of the groups mentioned in the preceding paragraph, or part thereof, or any particular person by reason of their membership they racist, anti-Semitic or other related to ideology, religion or beliefs, family situation, membership of members of an ethnic group, race or nation, national origin, gender, sexual orientation or identity reasons, for reasons of gender, illness or disability, or producing, processing, they possess in order to distribute, provide third parties access, distribute, disseminate or sell written or any other material or supports for its contents shall be able to injure the dignity to represent a serious humiliation, contempt or discredit any of the above groups, a part thereof, or any particular person because of their belonging to them.

b) Those who extol or justify by any means of public expression or dissemination crimes that had been committed against a group, a part thereof, or against a person because of their membership in that racially motivated, anti-Semitic or other related ideology, religion or beliefs, family situation, membership of members of an ethnic group, race or nation, national origin, gender, sexual orientation or gender identity, gender, illness or disability, or who have participated in execution.

The offenses are punished with a sentence of one to four years in prison and a fine of six to twelve months when it thereby promote or encourage a climate of violence, hostility, hatred or discrimination against these groups.

3. The penalties provided in the preceding paragraphs shall be imposed in the upper half when the facts had been carried out through a means of social communication, via the Internet or by using information technology, so that, that is made accessible to a large number of people.

4. When the facts, in view of their circumstances, are appropriate to alter the public peace or create a grave sense of insecurity or fear among group members, the penalty shall be imposed in the upper half, which may be raised to the top in degree.

5. In all cases, also impose the penalty of disqualification from profession or educational profession, in teaching, sports and leisure area, for a longer time between three and ten years to the duration of the deprivation of liberty imposed in its case in the judgment, in response proportion to the seriousness of the offense, the number of tasks and the circumstances surrounding the offender.

6. The judge or court will approve the destruction, deletion or disablement of books, records, documents, articles and any kind of support subject of the offense referred to the preceding paragraphs or by means of which had been committed.

When the crime was committed through information and communications technology, the withdrawal of the contents will remember.

In cases in which, through a gateway to internet or service information society solely disseminated or preponderantly the contents in the preceding paragraph refers to, blocking access or interruption be ordered providing the same.
