Ramón Román Díaz, Spokesperson for the Eagles in the City Council, raised the regular plenary session the following motion transactional (01/12/2010)

European Parliament resolution on the situation in Western Sahara

The European Parliament.

- Having regard to the relevant resolutions of the Security Council of the United Nations on Western Sahara

- Having regard to Resolution 1920 (2010) Security Council United Nations, extending the current mandate of the United Nations Mission for the Referendum in Western Sahara (MINURSO)

- Having regard to recent reports of the Secretary General of the United Nations Security Council on the situation in Western Sahara, April 14, 2008, to April 13, 2009 and April 6, 2010,

- Having regard to the International Covenant on Civil and Political Rights, ratified by Morocco on May 3rd, 1979,

- Having regard to the Euro-Mediterranean Agreement establishing an Association between the European Union and its Member States on the one hand, and the Kingdom of Morocco, on the other, in particular Article 2,

- Having regard to the European Union Declaration of 7 December 2007 on the eighth session of the EU-Morocco Association and the Joint Declaration made by the first EU-Morocco, on March 7, 2010,

- Having regard in particular, the conclusions drawn from visits made by its ad hoc delegation to Western Sahara in September 2006 and January 2009, which called for the extension of the mandate of the United Nations Mission for the Referendum in Western Sahara (MINURSO), provided that all parties agreed, to confer powers to control the observance of human rights in Western Sahara, and which called on the Commission that, if considered appropriate, and through its Delegation in Rabat, monitor the situation of human rights in Western Sahara and send regular assignments

- Recalling its previous resolutions on Western Sahara, in particular that of 27 October 20051

- Having regard to the statement made on November 10, 2010 by the High Representative of the European Union, Catherine Ashton, on Western Sahara

- Having regard to the statements by the Council and the Commission of November 24, 2010, on the situation in Western Sahara

- Having regard to Article 110, paragraph 4 of its Rules

A.

Whereas thousands of Saharawi fled their cities and set up tents on the outskirts of Laayoune, creating Izik Agdaym camp to protest peacefully for their social, political and economic and living conditions

B.

Whereas, after several weeks, these people became, according to United Nations monitors, about a 15 000, and is engaged in a dialogue with the authorities

C.

Whereas on Sunday 24 October, the Moroccan army Elgarhi Nayem killed a teenager Saharawi 14, and wounded five others when they tried to reach the outside ampamento Laayoune

D.

Whereas the November 8, 2010 a still unknown number of people, including staff of the police and security, were killed during the operation of the Moroccan security forces aimed at dismantling the protest camp deAgdaym Izik, considering also have received information about a large number of civilians wounded when security forces used teargas and batons to clear the camp,

E.

Considering that these incidents occurred on the same day that opened in New York the third round of informal talks on the status of Western Sahara, which Morocco took part, the Frente Polisario and the observer countries, Algeria and Mauritania,

F.

Whereas it has prevented the entry of journalists, national and regional representatives of the EU and MEPs to Laayoune and Izik Agdaym camp, and some of them have even been expelled from Laayoune

G.

Considering the violent death of a Spanish citizen Babi Hamday Buyema in circumstances that have not yet been clarified,

H.

Whereas, after over 30 years, the process of decolonization of Western Sahara has still not completed,

I.

Whereas the EU remains concerned by the conflict in Western Sahara and their implications and regional implications, including the human rights situation in Western Sahara, and fully supports the efforts of the Secretary General of the United Nations and his Personal Envoy in favor of "a just, lasting and mutually acceptable to allow the determination of the Saharawi people, as advocated by the United Nations resolutions,

J.

Whereas several reports have shown that Western Sahara's natural resources are exploited, without providing any benefit to local people

For all the above, since the call for the adoption of the following agreements:

1.

Express our deepest concern over the sharp deterioration of the situation in Western Sahara, and strongly condemns the violent incidents that occurred in Izik Agdaym camp when it was being dismantled and the city of Laayoune;

2.

We call on all parties to remain calm and refrain from conducting any further acts of violence;

3.

We mourn the loss of lives, and expresses its solidarity with the families of the victims, the wounded and missing;

4.

We note the establishment by the Moroccan Parliament a commission of inquiry to investigate the course of events that led to the intervention of the Moroccan authorities, but believes that the United Nations would be the most appropriate body to conduct an investigation independent international fact-finding, the deaths and disappearances;

5.

We apologize for the attacks on press freedom and information have been many European journalists and calls on the Kingdom of Morocco to allow free access of the press, independent observers and humanitarian organizations in Western Sahara and their free movement within the territory , regrets that the Moroccan authorities have banned the entry to Western Sahara deputies, journalists, media and independent observers.

We stress the need to ask the United Nations bodies to propose the establishment of a mechanism for monitoring human rights in Western Sahara;

7.

We welcome the resumption of the informal meetings between Morocco and the Polisario Front under the auspices of the Personal Envoy of the Secretary General of the United Nations, even in the tense circumstances, and calls on regional actors to act in a constructive manner;

8.

Remember to support the resumption of informal negotiations between the warring parties with a view to achieving a just, lasting and mutually acceptable in accordance with relevant resolutions of the Security Council of the United Nations;

9.

We ask the Commission to ensure that humanitarian aid is allocated necessary, an increase of funds for Sahrawi refugees, whose number is estimated between 90 000 and 165 000 living in the Tindouf region, to help them meet their basic needs of food, water, shelter and medical services and to improve their living conditions;

10.

We express our concern over the arrest and allegations of harassment of Sahrawi human rights in the territory of Western Sahara and calls in question the human rights defenders imprisoned in the territory and in Morocco in accordance with international standards and with a prompt and fair trial;

11.

We ask the EU to urge the Kingdom of Morocco to abide by international law in regard to the exploitation of natural resources of Western Sahara;

12.

We ordered our President to forward this resolution to the Council, the Commission, the EU High Representative for Foreign and Security Policy, Secretary General of the United Nations, the Secretary General of the African Union, the Delegation PE for relations with Maghreb countries and the Arab Maghreb Union, the Bureau of the Euro-Mediterranean Parliamentary Assembly, the Parliament and the Government of Morocco, the Polisario Front and the governments and parliaments of Algeria and Mauritania.
